Sharing a few E-Mails exchanges between me and Polk County Code Enforcement (Hank Smith).. ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
This is the same song Bb stab & Management have been singing for over a year. IMO, it fits Bb's "MO" with his past behavior in business adventures in Iowa.
Polk County after all this time, still needs more information on the tower structures. What Engineer in his right mind would sign off on these Towers. The footings for these towers, never had a Polk County Inspection, or a legal permit. I keep asking myself and Hank Smith, what is the problem..... I give Hank credit, he does answer his e-mails promptly.

The Building Department has also been working with them and I know permit numbers have been assigned, but at my last check of the Building Department Permit Data Base, they had not been issued due to Building Department request for additional information. It has been almost a month since your last correspondence about KCNetwork Tower Permits.. Have the permits been issued yet? If so who are they issued to?
Documentation as to who owns the Towers on SLohA Common Property, has never been available to SLR's residents, after 3 Official Certified Records Request to SLohA, the answer is they do not exists.
Mr. D Brnd (past SLohA BoD President} did state at a Public SLR Meeting, that they indeed at one time had the Documents, but the Documents have been lost. That was about 8 months ago.

Mr. Ath, When cases require approvals, plans or other activities by respondents to bring properties into compliance, those cases may be continued at Hearing, as this one was. In this case, the Respondents were given additional time to complete whatever requirements/conditions necessary. You will recall there was a requirement for a variance which took time for review and Planning Board approval. Once approved, opponents appealed, so that took additional time to resolve. The Respondents had been working on plans but suspended that work until the appeal decision was rendered. Respondents have been working to get plans approved and have kept me informed along the way. Towers are not typical/ordinary plans; they require a specialized engineer and finding a willing, capable engineer was time consuming. Even with the proper engineer, the original plans submitted some time ago required some revisions. Revised plans have been submitted and I am waiting for permits to be issued. It is true this case has taken a long time, but when variances must be applied for and approved, then approval decisions are appealed, and specialized plans required, the time elapsed is not time wasted away. I believe I stated previously my willingness to work with the respondents as long as compliance was actively pursued and I was kept informed. Those things have occurred and I will continue to monitor the case on the same premise. Should permits be issued without further case action on my part, there will be no fines assessed. This issue has been going on for at least 6 months or more. So after all of this time has past they are just getting around to supplying the engineering study and approval. I was under the impression this was submitted to the County back in the Spring of 2015.
What about the Hearing that was scheduled in January 2016. What is the present status on the Hearing and the Citations. Will they be paying the fines any time soon, or have the Fines been forgiven?

Jm Ath, Have You or anyone Else forwarded the information regarding Mr. Stabbs Criminal Records in Linn County, Ceader Rapids, Iowa to Mr. Smith? I would do that But I do Not know how. From the documented correspondence it Appears to Me that Mr. Stab certainly IS IN CHARGE OF AND OWNS the Towers in SLR!

Up-Date on Tower Permits as stated by SLR's Manager on April 20th at the Board Meeting.
After any BOD Meeting is over, a resident has a 3 minute window of opportunity to ask a question. So I asked about the "Permits" for Kay c-Ntwerk's Communication Towers. Below is the question and Chap's reply..
"Owner asked status of communication towers. Chap replied that SLohA has given Polk everything it has asked for. Polk is waiting for a licensed commercial contractor to "sign off" on the work and submit the permit application under their name." Forum Administrator said: ( I wonder how stab will get around this since he had no commercial contractor direct the tower construction.)
Polk County is telling me that it is waiting for a Licensed Special Structural Tower Engineer to approve and "sign off" on the Towers in SLR. Polk County did say about 3/4 months back, that it takes time to find a Special Tower Engineer. So whether we are waiting on a licensed commercial contractor or a licensed structural engineer, SLohA and the residents have been "Waiting Way To Long".......

In order for a licensed contractor to pull a building permit for the towers, he would have to attest that he actually built them (or, at the very least, that the individuals who erected the towers were working under his direct supervision). By lying on the permit application, the contractor would face the loss of his license and possible misdemeanor charges. Therefore, there is no way a licensed contractor would agree to pull a building permit for those towers. The only way I can see that a permit could be issued is if whoever actually built the towers would take the written test, pay the necessary fees and provide evidence of the required insurance in order to become licensed. Even then, I'm not sure whether Polk County would allow that individual to pull a permit for the towers "ex post facto".

Happened to come across this in the Minutes of the Blue Jordan Forest HOA May 14, 2014:
At least THIS proposal was for a private lot within the subdivision and NOT on common property. Presumably, the HOA governing docs permitted the tower within the community. Even back then, the HOA was responsible for the tower that stab would build (without a Polk permit?)

I posted a picture of the Towers and Antennas at the Commercial ISP know as KCNetwork in S-bag Lake Resort on GrayHackle Street. This is "one ugly lot", and it's main purpose is to provide for Profit Internet Service to as many as 2500+ residents in southeast Polk County. I do not know of any "Resort" in the state of Florida with such a dump located in their Resort. This "ugly dump of a lot" would only be seen on the other side of the railroad tracks, or maybe in a Fish Camp, not in "A Resort".A Con and SLohA Board of Directors allowed this to happen, this BOD even supported ISP KCNetwork, there by neglecting SLohA Board of Directors Fiduciary Duties. I would like to see the BOD's signed certificates, they do not read/study SLohA's governing documents, when newly elected, as per Fl. 720 statues. What happen to SLohA's Official Corporate Seal? I know, you do not have a clue what the heck I am talking about. O-Yes, just "tidy things up a bit" gang..... This marriage has one to many bed partners, the smell is in the air.....

(1)(a) Within 90 days after being elected or appointed to the board, each director sH all certify in writing to the secretary of the association that he or she has read the association’s declaration of covenants, articles of incorporation, bylaws, and current written rules and policies; that he or she will work to uphold such documents and policies to the best of his or her ability; and that he or she will faithfully discharge his or her fiduciary responsibility to the association’s members. Within 90 days after being elected or appointed to the board, in lieu of such written certification, the newly elected or appointed director may submit a certificate of having satisfactorily completed the educational curriculum administered by a division-approved education provider within 1 year before or 90 days after the date of election or appointment. (b) The written certification or educational certificate is valid for the uninterrupted tenure of the director on the board. A director who does not timely file the written certification or educational certificate sH all be suspended from the board until he or she complies with the requirement. The board may temporarily fill the vacancy during the period of suspension. (c) The association sH all retain each director’s written certification or educational certificate for inspection by the members for 5 years after the director’s election. However, the failure to have the written certification or educational certificate on file does not affect the validity of any board action. (2) If the association enters into a contract or other transaction with any of its directors or a corporation, firm, association that is not an affiliated homeowners’ association, or other entity in which an association director is also a director or officer or is financially interested, the board must: (a) Comply with the requirements of s. 617.0832. (b) Enter the disclosures required by s. 617.0832 into the written minutes of the meeting. (c) Approve the contract or other transaction by an affirmative vote of two-thirds of the directors present. (d) At the next regular or special meeting of the members, disclose the existence of the contract or other transaction to the members. Upon motion of any member, the contract or transaction sH all be brought up for a vote and may be canceled by a majority vote of the members present. If the members cancel the contract, the association is only liable for the reasonable value of goods and services provided up to the time of cancellation and is not liable for any termination fee, liquidated damages, or other penalty for such cancellation. (3) An officer, director, or manager may not solicit, offer to accept, or accept any good or service of value for which consideration has not been provided for his or her benefit or for the benefit of a member of his or her immediate family from any person providing or proposing to provide goods or services to the association. If the board finds that an officer or director has violated this subsection, the board sH all immediately remove the officer or director from office. The vacancy sH all be filled according to law until the end of the director’s term of office. However, an officer, director, or manager may accept food to be consumed at a business meeting with a value of less than $25 per individual or a service or good received in connection with trade fairs or education programs. (4) A director or officer charged by information or indictment with a felony theft or embezzlement offense involving the association’s funds or property is removed from office. The board sH all fill the vacancy according to general law until the end of the period of the suspension or the end of the director’s term of office, whichever occurs first. However, if the charges are resolved without a finding of guilt or without acceptance of a plea of guilty or nolo contendere, the director or officer sH all be reinstated for any remainder of his or her term of office. A member who has such criminal charges pending may not be appointed or elected to a position as a director or officer. (5) The association sH all maintain insurance or a fidelity bond for all persons who control or disburse funds of the association. The insurance policy or fidelity bond must cover the maximum funds that will be in the custody of the association or its management agent at any one time. As used in this subsection, the term “persons who control or disburse funds of the association” includes, but is not limited to, persons authorized to sign checks on behalf of the association, and the president, secretary, and treasurer of the association. The association sH all bear the cost of any insurance or bond. If annually approved by a majority of the voting interests present at a properly called meeting of the association, an association may waive the requirement of obtaining an insurance policy or fidelity bond for all persons who control or disburse funds of the association. The towers and gear were damaged by vandals at multiple sites, tower owners were contacted and told xxxxxxxxx would soon be out of business, and the internet supplier was even contacted and told to discontinue service on circuits' xxxxxxxxxxxxxx had purchased to run their business. As you can only imagine, it was not long until the owners of xxxxxxxxxx could no longer fund the business and was eventually forced out.
It was only later that it was discovered who the real person was behind these constant mishaps that caused xxxxxxxxx to fold. Hence the birth of xxxxxxxxxx service brought to you by xxxxxx. Not only did xxxxx force the shutdown of a hard working business family, but also took over the assets they work hard to build. The towers built by xxxxxxxx costs over $100k to build and xxxxxxxx acquired them by being decisive and at no cost to them out of pocket. After learning xxxxx past, one must not be surprised at his horrible business tactics and what he does to steal from an honest person. Unfortunately the damage is done and many people suffered from the fall out. All one can hope is that the madness stops and xxxx is locked behind bars once and for all. "End Quote"

It is my feeling that the person posting this detailed content has "inside" information. As suggested by the thread's name, I have long suspected that there is much more to be learned about the sudden disappearance of one business and the almost immediate replacement by another business. The story will emerge one day.

How long does it take a Law Firm to write a Bill of Sale/Lease Agreement with KCNetwork ?
Management (Toneesha) stated that they wanted the Agreement to be done correctly, with out any loop holes, that could possibly cause a liability for owner/residents, and that could be why it is taking so long to get this document together.
Again S-bag resident/owners are left wondering what is going on behind closed doors.
Just maybe they have finally realized who they are dealing with, I do believe all things about KCNetwork are in Virg inia Sta ibs name only...
Nothing about KCNetwork, that I can find is in Rob-bert St aibs name, he is not the registered owner, why is that? Could it because of his past business adventures?
