Dear Ms. BearIt,
Our firm has the pleasure of representing Jm and Jew-D Ath, owners within the S-bag Lake community. Our clients have a dispute regarding a breach of the restrictive covenants whereby the S-bag Lake Owners Association, Inc. (the “Association”) is not enforcing the prohibition against operating a commercial business within the community. More specifically, KioskCenters LLC d/b/a KCNetworks, is operating an internet-provider service, has installed multiple towers upon the common areas of the community, and the owners of the business, Robber and Virginia stab, are operating the business out of their home in the community with the service vehicles frequently on the premises. Additionally, the towers have been “donated” to the Association, who provides insurance coverage for the towers, but has no obvious business use for these towers. The towers and the one located on the residence of the stabs provide internet services for some members and other homes outside of the community.
As a preliminary matter to the filing of litigation, we are submitting to you the enclosed Statutory Offer to Participate in Presuit Mediation on behalf of the Auths. Of course, we are open to any offers of resolution during the time period prior to a scheduled mediation.
We have attached a list of five possible mediators. If you know of any other mediators, we will be happy to consider them. Please read the offer carefully and reply at your earliest convenience. If you have any questions, or wish to discuss the matter further, I can be reached at 321.299.9412.
