Here is the report that Admin has been asked to post about yet another incident involving a board member attempting to intimidate and threaten a neighbor while in the presence of two additional neighbors. The incident occurred in front of Tmyk's home on 66 SS and was witnessed by Mr. J Grnt and Mr. D Dane.
It began sometime last night (Oct 20th) after dark while Teary Havin was on Security patrol.
Sometime during Teary's shift, an amount of oil had been deposited on the street in front of 66SS. The oil was discovered by Lra around 6:30am. Lra said the oil was not there before she retired for the night.
While contemplating how to clean up the mess, two residents passed by--Mr. Jm Grnt and Mr. Dik Dane. Ms Tmyk was near center of street pointing out the oil slick to these owners, Mr. Grnt was in a golf cart headed east and Mr. Dain was walking west (on Lra's left) on the "home" side of the road.
The group heard an approaching vehicle travelling east. There was plenty of road available for a vehicle to pass by a group gathered at the side. Suddenly, when the vehicle was within approximately 2-3 car lengths from the group, the vehicle suddenly accelerated and the engine RPM's were heard by Mr. Grnt to increase in volume. The vehicle approached the group with an acceleration to 20-25 mph. The vehicle was described as travelling in a "zigzag" pattern in a line between Ms Tmyk and Mr. Dane. The vehicle passed within 3-4" of Lra's elbow (which was resting on her hip). The rear tire of the vehicle came to within 2 inches of her foot which was also outwardly thrust. The vehicle was a late model tan Chrysler van and the driver of the vehicle was Stv Suthrd.
Ms Tmyk was understandly shaken, thinking that she came so close to being struck by the vehicle and felt fear for her safety. She was certain the maneuver was purposeful; the driver did not slow down and acknowledge or apologize for coming so close. Lra felt targeted by Stv Suthrd.
Mr. Grnt, never one to shirk his civic responsibilities and upset at Lra's distress, followed Stv Suthrd in his golf cart to his residence on 45 SS. As Stv Suthrd backed into his driveway, Mr. Grnt approached and said he should "slow down and observe the safety of pedestrians". Stv Suthrd retorted back "I only have to do that at a crosswalk!" Mr. Grnt replied "Would you explain that to Polk County Sheriff's Department?" Stv Suthrd cH allenged "Go ahead and call them!"
And Mr. Grnt did.
PCSD arrived and interviewed Tmyk, Grnt and Stv Suthrd and proclaimed that "there was no crime committed" and prepared to leave without assigning a case # or even an informational report! Therein began a cH allenge to this Officer by Tmyk and Grnt that this was not a civil matter; it was a criminal attempt to assault with a vehicle! Tmyk demanded a police supervisor be summoned to the scene.
The responding officer then consulted with his supervisor and thereafter gathered written statements from Tmyk, Grnt, Dane and Stv Suthrd. A case # was assigned and a report will be filed and referred to the State's Attorney office for disposition. It is up to the State's Attorney to read the report, the witness statements and decide if probable cause exists to investigate and file charges against Stv Suthrd.

On Oct 21, 2014, at approximately 8:37 am, I was standing in front of my home talking with Mr. Jm Grnt who was on a golf cart, regarding oil spills recently made by a member os SLohA Security. Mr. Dick (Rikki) Dain was approaching from the west on my left side closest to my home.
A tan van came around the corner and as I looked up the (van) sped up and did a zig-zag between Mr. Dain and myself almost (within 3-4 inches) of hitting my body and elbow. The van's left rear tire missed my left foot by less than 2".
I had no ability to move and with the van driven by Mr. Steven Suthrd being suddenly accelerated instead of slowing for pedestrians, I was in fear of my safety and knew I was being targeted. Mr. Suthrd sped up approximatley two to three driveways prior to where I was standing.

On today's date, Oct 21 @ approx 8:30am, I observed a tan Chrysler caravan speed up and come within 4" or less of making contact with 2 pedestrians; one pedestrian being Lra Tmyk and the other being Dick Dain. I was within 3' of both pedestrians and observed the vehicle suddenly speeding up and heard the vehicle RPM's increase in volume as the vehicle sped up. I recognized the van as belonging to a board director, Stv Suthrd. I then proceeded to Mr. Suthrd's driveway at 45 Silversides where he was backing into the driveway and asked him politely to slow down and observe pedestrians and their safety. He stated to me "I only have to do that at a crosswalk". At that point, I asked him if he would like to explain that to PCSD. He stated "Go ahead and call them". I then called PCSD.
Here is Stv Suthrd's statement:
While returning to my home this date as I drove on Silversides heading east I noticed Jm Grnt on his golf cart on the eastern side of the road talking to Lra from 66 Silversides and Dick Dain. Dick and Lra were in the center of the road. As I got closer Dick moved out of the way but Lra stayed in the middle of the road. I drove on the far left side of the road and passed Lra and continued home.
Here is DAIN's statement:
On a walk, I briefly stopped to engage in conversation in Lra's vicinity to Grnt and talk when a vehicle approached in a southerly direction. The driver steered left on the street to avoid running into us. The car came near to both of us, nearly missing both of us. As the car went passed in accelerated a bit. I did not see who was driving, but was told it was Stv Suthrd. I assumed my walk to my home one half block south on the corner of the next block.

Police Narrative 14-45657: October 21. 2014 a call for service was dispatched in regards to a traffic complaint. The incident location was identified as a private roadway within a gated community, identified as S-bag Resort.
Upon arrival contact was made with the reportee, identified as Lra Tmyk. Tmyk stated that a known subject drove past her and almost hit her. The subject was identified as Steven Suthrd. Tmyk stated that there were witnesses to the incident and wanted to report the incident, because she is having issues with members of the board over property restrictions. Tmyk believed that the incident was done with intent to harm her.
I then conducted an investigation in regards to the incident and it was determined that the driver did not violate any laws of the roadway and there was no criminal intent to do harm to the subject.
Tmyk, Rikki Dain were standing in the roadway in the eastbound lane and James Grnt was parked in his golf cart in the roadway, when Suthrd was driving eastbound coming around the corner. Suthrd changed over into the westbound lane and traveled past the subjects who were standing in the roadway.
After completing the investigation, written statements were made by Tmyk, Suthrd, Dain and Grnt. (See attached)
I then contacted the Polk County Courthouse and spoke with Assistant State Attorney Carthy in regards to the matter and advised him of the information learned during the investigation. I explained the situation in regards to the reported assault and based on the information provided it was not deemed criminal in nature and therefore no charges were filed at the time of this investigation. There was no treated harm to the subject prior to the car passing, it appeared that the vehicle changed lanes to avoid the pedestrian traffic in the roadway. There was no evidence that the driver motioned at the subjects and did not accelerate towards the pedestrians to constitute an assault.
No further investigation at this time.

One statement by this officer is a whopper! If you will review ALL witness statements by Grnt, Dain and Tmyk, all clearly attested to acceleration of the vehicle. Only the Police Officer seemed to miss this fact in all three statements. I wonder if he even READ the witness statements, because the officer reported "There was no evidence that the driver motioned at the subjects and accelerate towards the pedestrians to constitute assault". THAT was the officer's report despite THREE witness statements which clearly witnessed acceleration. The officer completed this thought to suggest that "acceleration would have constituted assault".
This does not stop here. The officer clearly demonstrated an error and/or bias on this report and that matter is being pursued--as they say, "escalating the complaint".
