He is the KING of Kollections and foreclosures. His emphasis is on real estate and foreclosing. He is a master at scarfing up distressed owners' homes for missed assessment payments. Many articles and complaints have been written about him.
S-bag currently has 3 parcels not up to date with collections. I would like to know why this specialty attorney was selected to "educate and inform" membership about representing HOA's. Is HE our next corporate attorney? Worse than what we already have! Shut the Door!!

October, 2016 VOL 36 No. 1 PRESIDENT’S MESSAGE The S-bag Express is back and soon the rest of us part-timers will be heading back too. Over the summer, some of you may have been following my “President’s Messages” on our new website. If you Hayvn’t used the site yet I hope you will find slresort.net this season and join the other 366 residents who have now logged in nearly 10000 times, in just 9 months! I won’t try to recap the entire summer but for anyone still wondering. Several of us testified in a discrimination hearing, in late June. We are still awaiting a ruling in that case. That was the same day that we had an armed fugitive on the loose in the Resort. No harm done. We did get approval from the DEO for our Revitalized Covenants and all our owners should have received a copy of our “Governing Documents”. Then a cH allenge against the DEO ruling was filed by one of our owners. That is to be held on Sept. 26 so we may have a ruling on that by the time that you read this. We will see where we stand when that is resolved. It seems the justice system moves with glacial slowness but attorneys still charge by billable hours. People are entitled to seek justice through our legal system and we all value that protection but it is unfortunate when we are forced to spend such a substantial amount of our budget defending ourselves against cH allenges from our own SLohA membership. Remember last year’s budget surplus? We will need it. But it’s not all gloom and doom. Our staff and management have been hard at work: painting, pruning and polishing in order to have things in ship shape when we all arrive. From the front gate to the Post Office and the storage area at the back of the Resort you will see the results of their labor. Well done everybody! There is always lots to do as we get geared up for the fall and winter activities in the Resort. The various clubs will be looking at reorganizing and setting their events calendars and the Board of Directors will again be able to meet face-to-face to get the all-important committees functioning so that our various plans and projects can move ahead. I made an appeal for help in one of my summer messages and I would like to repeat that appeal here. We have lost a number of our hard workers over the past year and we have important positions to fill. If you are a newer owner or someone who has never before served in the leadership of one of the clubs or committees or run for a position on the Board of Directors, think about it. It is only with the continued effort of us all that we can ensure that S-bag will continue to be the active and progressive place that we have come to love. Nunsee and I plan to arrive about Nov.1st. Thanks to all the street volunteers for their work during the summer. We are all very thankful that there hasn’t been severe weather this season, but hurricane season will continue through November 30. The CERT and Emergency Committee will continue to hold joint meetings through November. The next meeting will be October 3 after Koffee Klatch. We would like to advise all residents to familiarize themselves with disaster procedures. Please read the information given to you by your street volunteer. Also, remember that pets must be in cages if brought to the authorized pet facilities during a disaster. Thanks to CERT/Emergency members who organized supplies, pressure washed and painted the sheds in the storage area. Here are some projects since last time I wrote to you. We have worked to help keep SLR looking and running great. JCW painted the sewer plant and it looks great. All the lines are color coded by the materials they carry, and the paint helps keep pipes from being directly exposed to the elements increasing the lifespan. The erosion issue with the drainage on the greenway behind Gngr quill has been fixed. Jhn filled in the sandy areas that were washing away with crushed tile. This should prevent any more of the hill facing from being washed out into the lake. Modern Fold repaired the damaged Clubhouse divider that separates room A&B. The recreation room floors were repainted to repair areas that had started peeling. The Greenways along the fence line from Silversides to Pink Lady have been cleared. Prior to being cleared the fence line was not accessible by maintenance. All S-bag employees received training, and became CPR certified, and trained in the operation of the AED machines. Completed the first section of the ongoing rehab of the storage area. This project will be completed over the course of several years and done in sections. The lots are being filled with crushed tile to allow proper drainage and prevent flooding. Each lot is also being re-graded and re-marked. The first completed section included lots 100¬121. The Red Quill greenway was graded and sodded. It now allows proper drainage from the Red Quill area to the lake. Flow meters have been installed throughout the Resort to monitor the sewer system. This is a 2 month long project to help pinpoint the water infiltration issue with the sewer system. If you are not a crafter but do some traveling, I hope have saved the full toiletries that are available in motel rooms. These are also included in the ditty bags. It is amazing how a little collection when combined with others yield many, many pounds of toiletries!! Thanks to all who have contributed in the past. This story has a long history -- so it seems? It first started when a naïve board hired a contractor who didn't have the correct license (CONTRACTOR'S LICENSE 1998). And from then on it all went downhill. Just read the article "Shoddy Siding Proves Expensive" published in the Tampa Tribune on April 27, 2006. It gives you an insight into the many problems. The problems about the not-repaired repairs came to a boil when the board decided to levy a special assessment, without having all their ducks in a row. And some of the owners obviously took offense when Steven H. Mezer, well-known attorney from the law firm of BUSH Rss, P.A. in Tampa, made a speech at a special meeting that some owners considered offensive and outright threatening. If you listen to the tape you might easily understand why! And since a majority of the owners in Lake Place I Condos weren't happy with the decision made by the board, the board was served shortly thereafter with a recall petition, according to Florida Statutes 718. According to documents, the management company was served with 27 recall petitions on April 21, 2006, petitions filed according to DBPR guidelines. Everybody expected the board to hold a meeting within 5 business days in order to decide if they wanted to certify the recall or to cH allenge it, as provided in the Florida Statutes 718.112(2)(j). When the Board didn't post that meeting notice 48 hours ahead of the 5 business day deadline, the new Board-elect majority posted a notice of their organizational meeting. That notice was ripped down and replaced with the following note: APRIL 26, 2006

Per your request , I have reviewed the petitions for recall that were given to Wise Property Management. The petition were so defective and deficient that you did not have to hold a board meeting or an arbitration. They were not even close to being in compliance. The Board has not been recalled. You may share this e-mail with Mr. Colodny or any other unit-owner IF approved by a majority of the board members. Stv Steven H.Mezer, Esq. Bush Rss, P.A. 220 South Franklin Street Tampa, Florida 33602-5330 Written by attorney Steven Mezer, the posted notice told the board that the recall petition was (quote) "defective and deficient,” so no meeting was necessary -- all according to the attorney. No board meeting took place that saw a vote of the board considering this "ruling" from the attorney -- who is not a judge -- the board took no action other than just posting the notice. ............................................................................................ Steven Mezer clearly created his own judgment -- totally incorrect as we saw later -- that led to more than 5 (five) months of very expensive legal wrangling. Mezer as well decided that mandatory arbitration wasn't necessary, but filed instead a TEMPORARY INJUNCTION, accusing the petitioners to have done everything wrong by not following Florida Statutes. As it turned out -- Mezer was absolutely wrong again! From the Temporary Injunction Mezer went to file a LAWSUIT demanding legal fees, which, because his obviously wrong judgment call, had taken on immense proportions. The Petitioners for Recall, surprised by Mezer's actions that were, according to the DBPR arbitration section, not based on Florida Statutes, filed their own recall petition -- on advice of the DBPR. Maybe because I'm not an attorney and just use my common sense, in my book you lose by default if you don't follow the guidelines and don't do what statutes and ABR are demanding you to do! In my opinion the DBPR arbitration section failed the owners at this time by not entering a default judgment. It all went its merry way -- for more than 5 (five) MONTHS -- to the tune of outrageous legal fees -- and lots of frustration by the owners who had relied on the Florida Statutes, trying to follow the rules. It actually took the arbitrator more than 5(five) months to make a decision. On October 9, 2006 arbitrator James Earl finally issued the FINAL SUMMARY ORDER, in favor of the condo owners, represented by Jon Zuch, the petitioner. This final summary order plainly said what the petitioners said all along: Their recall petition was flawless and created according to the Florida statutes and the DBPR guidelines. But, in order to add insult to injury, it is pretty obvious that the looming adverse decision against the sitting board was leaked -- and caused the association members even further financial harm -- harm they tried to avoid by serving the board with the recall petition on April 21, 2006. Out of nowhere the sitting board called a special meeting on Sunday, October 8 at 10 a.m. and voted to sign a three-year contract with Vanguard Management Group, Inc -- with a very expensive escape clause. The sitting board members (their last official day in office) knew that this contract would have never been signed by the new board, that was finally installed on Monday, October 9 -- 171 days after the recall petition had been served. To make it very clear: This is absolutely outrageous! The wrong judgment of the attorney not only created legal fees that went through the roof! This recall petition would have been decided in no time, if the attorney on record for the board, Steven Mezer, wouldn't have attempted everything to derail the recall petition. He should have just let the recall work through the system as described in FS 718.112(2)(j) and Rule 61B-23.0028, Florida Administrative Code. But this way it bought the sitting board more than 5 months of time to do things against the will of the majority of the owners -- and filled the coffers of the attorney! In my opinion the person who created the cost should actually pay for it! If you hire a so-called professional, you should be able to rely on his/her advice, especially when making such strong statements as can be seen above. Or maybe some more boards should consider suing these "professionals" for malpractice! That might finally get the attention of some of these "professionals" who love squandering the association dues by filing frivolous lawsuits! We finally need a legislative statement that not following the rules will cause a quick default ruling. Why should people be rewarded for not following the rules by being allowed to stay in power for another 5 months, against the will of the majority of the owners? According to DBPR statements, it takes no longer than 60 days on average for a regular recall ruling. This example shows that you can buy nearly 6 months’ time if you don't follow the rules -- and then just wait for the soon upcoming elections to create more havoc! Five months is a long time to squander legal fees and create financial shenanigans to the detriment of the owners! Several years ago, I corresponded with a homeowner who was experiencing abusive tactics by his HOA to collect a debt. This person WON his case against his HOA. He is an advocate for homeowners who are abused by their HOA with regards to collections and foreclosures. He might be a good resource if you ever find yourself bullied by a "collection/foreclosure" attorney. Here is the email and his contact information:

Posted in the 2016 October S-bag Express: This is somewhat confusing. WHO is Steven Mezer employed by? Answer: Becker & Poliakoff. B & P recently opened an office in Tampa and Mezer joined the group in July 2015. This law firm is the largest and best known HOA practice in Florida. I suspected that B & P was the 2nd opinion lawyer discussed, but not identified, in the Dec 2015 Board meeting where the Revitalization Committee met in secret and discussed either going ahead with or holding up the revitalization, based on issues discussed with the unnamed second attorney. Stv Suthrd was especially cautious about going ahead with revitalization as then-planned, citing the discussion held with the attorney. Blkbrn and listerine were especially aggressive about going ahead with revite , as planned, despite the lawyer discussion. Most other directors were "deer in the headlights" --without comment. At that time, there was some concern expressed by directors about the Current Management Company referral attorneys--not specified-- but everyone is aware of how expensive and nasty it has become in S-bag since that group "took over". My intuition told me that there was an alternate attorney firm being quietly vetted behind closed doors. Good question to ask Mr. Mezer ie. was the 2nd attorney opinion consulted HIM or someone else from Becker & Poliakoff? If the answer is yes, then our board has failed once again to give proper notice of a board meeting and followup with Minutes. A review of the audio of that meeting reveals that a quorum of directors was present either in person or electronically. There was an agenda distributed to the directors. A quorum gathering of directors requires Member Notice and Minutes. It was not about pending or actual litigation or privacy employee matters so it was not a "closed" board meeting (or a "privileged" meeting as the BOD likes to say). I have seen no announcement on any website controlled by stab or Stmbug Ixx nor has anyone seen anything posted on the property.
IMO, this was a good call. Now is NOT the time to engage a Foreclosure-specialist attorney in the middle of a currently-litigated dispute about SLohA's authority to foreclose on homes. (Lien/foreclosure authority is one of the 3 disputes in the DEO cH allenge which questions SLohA's status as a homeowner association and therefore precludes eligibility to revitalize.)
To say nothing about the discomfort of fielding questions about the Dec 2015 secret Revite Committee Meeting attorney...
