I recently lost a possible sale of my house. After trading emails and phone calls, they decided to look elsewhere to buy a home, citing the "peripheral concerns" of buying a home in SLR. All seemed to be going well; they were qualified buyers, the asking price was not a problem, they were anticipating being extended parttime and did not want a Sm all seasonal vacation cottage and demanded a deeded property rather than a leased one; my house seemed perfect for them in every way! But, during a later conversation, I believed we had arrived at a point where disclosure was necessary. (I was a licensed real estate agent for over a decade and believe I understand when a material disclosure must be at least approached--which I did with caution. But, unfortunately, the buyer was too risk-averse to want to add this factor into their homebuying scenario.) This was the not the first potential sales inquiry but it was the first serious one abandoned that I can attribute to the "covenants problem".
Yes--you can say I caused this myself and you would be correct in the sense that I knowingly chose to legally OBJECT to another interest clouding the title to my property and that this sales difficulty is the collateral damage of my formal legal action to defend my title.
