This proposal failed. There is increasing pressure on Legislature to attempt to limit HOA owners ability to rent their units, especially with regard to short-term BnB rentals. This is a material (Covenanted/contractual) property right. Rental limitations are much more common in condos but generally absent or quite limited in HOA's.
SB 1186: Homeowners’ Associations
Homeowners’ Associations; Specifying requirements for amending a homeowners’ association declaration; providing that nonmaterial errors or omissions do not invalidate a properly adopted amendment; providing that an amendment restricting a parcel owner’s ability to rent his or her property applies only to certain parcel owners, etc.
Interestingly, the most recent FL poll on this issue is that around 80% of homeowners are IN FAVOR of BnB rentals. This number could be expected from investors and younger owners.
