I just got an email from a friend who sued their HOA 2 years ago for refusal to fulfill a records request. The Owner has prevailed and has been awarded $4,000 which the Association must pay. This was in Broward County, FL.
I am aware of another lawsuit that is currently pending with the DPBR by a condo owner who was refused access to inspect Official Records.
The Condo Reform Bill of 2017 attempted to attach a criminal penalty to a condo association that refused to provide Official Records to owners; however, the pushback by ATTORNEYS and the CAI was so intense that the proposal was dropped...for now.
