Attachment DeletedA bill to be entitled HB 123: Bullying and Harassment in Community AssociationsAn act relating to bullying and harassment in community associations; providing a short title; providing applicability; prohibiting the bullying or harassment of certain association members; providing definitions; providing association requirements; providing civil penalties; providing immunity from certain causes of action for damages; providing legislative intent; providing an effective date. An Association can prohibit posting of signs intended to bully or harass residents. Likewise, it could prohibit distribution of printed materials with the same ill intent, including Association produced newsletters or posts on official Association websites. BULLYING AND HARASSING would include the name checking of other Members with regard to matters which are specific to legitimate business of HOA but privacy concerns constrain the public dissemination of the business, such as when Members become delinquent in their payments or when Members are denied voting rights, denied access to common properties or when Member dissent through correspondence and lawsuits against the Board or HOA.

As expected, this bill "went nowhere".
However, Associations are now subject to a fairly new HUD rule which requires Associations to act effectively and intervene in neighborhood harassment. That rule is federal and actually has some enforcement teeth applicable to all housing providers--which includes HOA's.

It's Official! Anti-bullying bill postponed indefinately! No relief for bullied homeowners in Florida's HOA's. Regulation of this common behavior is not worthy of consideration by Fl lawmakers.
