BOD director: One of the reasons why I have changed my opinion of that motion we had this morning is that on second thought the attorney has not told us either way--he has not told us that it is illegal. Why can’t we therefore take the advice of the very thoughtful people in the management company who said we could do this? I think we should do it and let the chips fall. It is long past due for the tail wagging the dog in this organization.
What is interesting here is that a Board Member refers to themselves as "This Organization" .
The word "organized" also appears in the RICO Statutes

What I find totally RIDICULOUS for the owner of the internet business in here to get up and spout off at the meeting that:
1)The 20 people w/the form letters are taking away the rights of everyone else to vote; here's a thought: WHEN YOU GET YOUR BALLOT IN THE MAIL AND MARK IT THE WAY YOU WANT--HOW IS THAT TAKING AWAY ANYONE'S RIGHT TO VOTE? NO ONE'S RIGHT TO VOTE IS BEING TAKEN AWAY--JUST REMEMBER HOW STUPID OF A COMMENT B.S. MADE WHEN YOU GET YOUR BALLOT AND MARK IT AND TURN IT IN--AT NO TIME DID ANYONE TAKE AWAY THE VOTING RIGHTS OF ANYONE ELSE IN S.L.O.A.!
2) NOBODY'S CHOICE OF HAVING THE INTERNET IN THEIR HOME IS BEING TAKEN AWAY FROM THEM EITHER--IF YOU WANT TO BUY INTERNET SERVICES FROM B.S.--THEN GO AND BUY IT FROM HIM--JUST DON'T FORCE THE OTHER HALF OF THE PEOPLE IN HERE THAT DON'T WANT HIS SERVICES TO PAY YOUR INTERNET BILL FOR YOU!
3) CONTRARY TO B.S.'S B.S.--THERE IS NO "CONSPIRACY"; THIS IS MERELY THE RANTING AND RAVING OF AN UNSCRUPULOUS BUSINESS MAN WHO FEELS HIS EASY MONEY--MONEY HE'S GOING TO GET OFF OF HALF OF THE PEOPLE IN HERE THAT DO NOT WANT HIS SERVICES(IF HIS INTERNET PASSES)--IS SLIPPING AWAY.
4) B.S. HAS BEEN CONSISTENT IN PROCLAIMING THAT A CONTRACT FOR HIS SERVICES IS A WASTE OF TIME AND IS UNNECESSARY...WHY IS IT THEN, THAT ALL OTHER PROVIDERS OF SIMILAR SERVICES HAVE THEIR CUSTOMERS SIGN A CONTRACT--THIS IS IN DEED NECESSARY AND IT SHOWS B.S.'S INTENT TO BE ABLE TO RAISE PRICES SIGNIFICANTLY IN THE NEAR FUTURE TO PAY OFF HIS OLD, ARCHAIC EQUIPMENT AND PURCHASE NEW, MORE MODERN INTERNET EQUIPMENT--AS ALL OF YOU SHOULD WELL KNOW--THIS INTERNET IS NOT AT ALL MODERN--IT IS NOT WIRELESS, AS HE CLAIMS; THERE IS FAR MORE ADVANCED EQUIPMENT AROUND, IT MAY COST A BIT MORE, BUT YOU HAVE ASSURANCES AND GUARANTEES AND B.S.'S SYSTEM IS NOT SECURE--OTHER INTERNET PROVIDERS ARE SECURE.
5)WHEN B.S. COMES INTO YOUR HOME AND SITS AT YOUR COMPUTER, HE IS CONFIGURING YOUR COMPUTER TO HIS SYSTEM IN WHICH HE HAS BACK-DOORS BUILT IN TO SEE EVERYTHING YOU ARE DOING ON YOUR COMPUTER. THERE IS NO PRIVACY OR SECURITY WITH HIS SYSTEM--JUST THOUGHT EVERYONE SHOULD KNOW THIS.

The removal of the internet extortion fee from the ballot is what BS is saying "deprives the people of the vote ON HIS INTERNET EXTORTION FEE--not that it deprives people of the right to vote". By withdrawing the option to ratify the ballot "WITH" or WITHOUT", he is saying people are denied a "right to vote". Of course, that is ridiculous!
There is more to this; however. By blending the internet extortion fee to the budget, you are fouling the process of ratifying the budget and risk the possibility of non-enforcement of the budget if legally cH allenged. These choices should be separate. Permitting a "spending bill" to be tagged to the budget vote is setting up a precedent where self-serving interests can add their own wishes to the budget, like they do in Congress by adding a pork barrel project to a popular bill. I don't believe that such a thing was envisioned when the bylaws were set up and they do not address this specifically, but silence on it does not mean legal permission to do it. The law cannot specify every greedy scheme that some shyster can dream up! The budget is important and should be its own item. Secondary "decision" issues should not cloud budget ratification.
That aside, the internet should not even be on the ballot in the form being proposed as a possible assessment. If BOD wants to sample opinion, the internet fee should be sampled as such and then proceed. The BOD still has no authority in the Covenants to force an assessment for an internet fee on parcels.
What they do have the option to do is to survey the members and see if the members feel there is sufficient value in having all those security cameras around (which have thus far seen nothing of a security value) and do the same thing for the value of CHUG. We already pay for Office internet services in our current assessment--KL made it sound like we would be left without business internet! If owners think that these are valuable services to add to the Operating Budget, then BOD need only sample the members and proceed to either drop it or negotiate a suitable contract with a provider or providers for these services and add them to a Line Item in the budget to be rolled into the assessment. Fine. No problem.
So why are they doing it THIS way and risking a legal cH allenge which they will certainly lose?

January 7, 2014
DRAFT -- Pending Approval, SLohA Board of Directors Workshop Meeting
President, K L called the meeting to order at 09:01 a.m. in the Memorial H all.
Roll Call: P B, D B, C J, A K, K L, C M, A R, F , S B were present.
Sxxxxxxxx Ixx, Inc.: M K was present.
C M moved that the agenda be adopted. F seconded motion. Motion passed unanimously.
C M moved that the minutes from the December 18, 2013 meeting be adopted as presented. S B seconded the motion. Motion passed unanimously.
M K gave Managers Report. Will be posted in SLR and on the CHUG website.
K L: Presidents Report
Need to look at the SOP concerning boat dock use in the future. There has been some complaints as to individuals having reserved boat slips but not using them for several months at a time and policies do not address this issue and others.
Honorary Wall in Memorial H all. President feels that the board of directors should not be the ones to decide who gets a plaque, size of plaque, etc. There is a need for a committee to make these decisions. Since it is very difficult to get individuals to volunteer, possibly the committee could be made up of the Presidents of the different social groups. Those that want to donate honorary plaques would go to that committee who will in turn decide on the size, shape, etc. of plaques so they are uniform. Discussion. Asked that those in attendance and board members consider to be on that committee. Will be placed on agenda for next schedule meeting.
The board, at last meeting, made a motion to offer SLR owners 2 budget options for 2014-2015 budget. Since that meeting the board has received approximately 20 or so form letters stating that they feel that this action is unlawful. The question arises does the board have the authority to recommend to provide a service to the resort. Our attorney has advised that research needs to be done to determine how a question of presenting the owners of SLohA with an option to obtain a service not previously included in the annual assessment. Since it is an unknown, does anyone want to rescind motion made at last meeting? Discussion. P B moved that the motion previously passed at the December 18, 2013 meeting relative to adding the option to the ballot to allow owners to vote for the budget with or without resort wide internet be rescinded. F seconded motion. Motion passed with 8 in favor 1 opposed.
The question of services that this SLohA receives at no cost to us; for example: security cameras running 24 hours per day to thwart vandalism, SLR website, church services on line, board meetings, Koffee
Klatch, Home Listings [For Sale/Rent], this will all go away without this internet service that is now being provided. Think about what KCNET provides this resort/owners.
M K stated “I am going to speak to what the attorneys said about the objections to the second budget option. It wasn't necessarily that it was a second budget option or that it was that the internet was being added, it was the situation as a whole. The situation between SLohA and KIOSK center, there is no contract -- only an invoicing system which is fine, unless you get into a situation like this. Then you must show what you offer all what is free, all what is charged, etc., etc.. What is expected of the association? Their consideration [attorney] is for the liability for the association.
1] No contract 2] Nothing to research 3] They are not saying its illegal or that you can't add it, they're saying they need documentation and they need time to review to make sure the board is not making a mistake. If you ratify a budget that doesn't have all of this stuff in place, you ratify a budget that can not be enforced. Then you're back to square one."

C J made a motion to rescind the motion to take off the internet on the ballot. No action taken.
C J then made a motion that we add the option onto the ballot to allow the owners to vote for the budget with or without the resort wide internet. S B seconded the motion. Motion passed with 8 in favor 1 opposed.

A K: Board Correspondence
1] The following individuals submitted form letters to the board to register their objections to the boards unlawful action of providing 2 budget options: (names withheld by editor)
2] Letter from JB requesting the board respond to him as to what gives them the authority to levy and collect assessment for expenses which are not operating or a maintenance cost of managing SLohA owned property.
3] Letter from JA stating board minutes have not/are not including all owners comments. Requested all owner comments be given respect, acknowledged and entered in the minutes. President,
K L stated that under previous attorney advisement the only thing that should be stated under Owners Comments is the number of comments made. From this point on, that is all that will be stated in the minutes.
4] Letter from JH questioning legality of Mr. S running K C N on his property; his latest proposal to provide internet to the resort, and not believing that K C N is not making a profit.
Bingo Report: Bingo continues and is going well.
D B: Memorial H all ribbon cutting event upcoming. Date to be announced at next Koffee Klatch.
C J: Election Committee Update. Listed this years ballot Judges G T and M W respectively; counters and guards. Memorial H all to be closed on February 14th from Noon on for the counting of the ballots.
Rule Book Committee: Rule Book Committee informational meeting to be held tomorrow [January 8th at 9:00 a.m. at the clubhouse.
C M: Organizing a Communications Committee, have had some volunteers. Should have more information at next meeting.
A R: No Report.
F : Technology Committee has met. Looking into a] Electronic Billboard by the post office. B] Alarm system on pumping stations/sewer system. Next meeting January 22, 2014 at 3:15 p.m. at the office.
Unfinished Business: Has the board looked into the lack of access to under the oaks, remains problematic. Problem is being looked into.

KL just screwed up...again. Now, instead of a line or two about an owner comment at a meeting, he'll end up with a full page letter that will have to be read aloud at the next meeting, reviewed by the attorney (which one--the one he listens to or the one he ignores?) and answered. Question and answer will become part of the Official Record and SLohA will pay for attorney to "advise". He has created potential problems for SLohA by shutting down communication. Now everything will be in writing and SLohA will be on the hook. Good job Mr President!
Next year's budget should have a new Line Item under Operating expenses to account for KL-caused costs. Or it might be cheaper to hire a fulltime lawyer.

What a joke. "Discussion Continued"......... For about 2 hrs. This is a one page Draft, for a 2hr workshop. This is not the same meeting I attended.. Who are they Kidding? Our Pres rambles & babbles for 1/2 hr., then you scratch your head and say to yourself, what the heck is he talking about. I am glad these Meetings are recorded, because you can not make this bizarre stuff up. You have to read the Workshop's Transcript on the forum. It says it all....In their own words.....The Rest of The Story!!!

After all of this Kn L. admitted stalking and internet crap, he is still an adviser to the present BODs. It is like nothing wrong ever happened.
Amazing... This type of attitude and behavior is not new to our community, read the 1986 BODs Meeting Minutes.

Looking back and reading these old Board Workshop Minutes has to put a smile on one face. The comments are the greatest.
This Jan.7,2014 Workshop will be one of the most dysfunctional BOD Workshops is S-bag's history. I am told it was even better if you attended the Workshop.
Read on, Part 2 & 3 only gets better !

I was present at that Workshop and it was a one of a kind meeting. I will never forget it.
The S-bag Annual Meeting in 2014 was also a Bizarre Event, and one for the books, again you had to be there in person...... (16 RC)
