A little historical reminder that goes with the attachment. Mr. Shencavitz's 11 lb dog was savagely attacked by JC's 50 lb dog while the dogs were sharing the Dog Run area. Mr. Shencavitz's dog sustained serious injury, requiring emergency and ongoing veterinary care totalling almost $5000. Mr. Shencavitz subsequently sued SLohA because the rule prohibiting dogs over 30 lbs was not being enforced. He sued Mr. C because, as the dog's owner, he is responsible for damage caused by his dog.
The attachment is Mr. Shencavitz's lawyer's letter detailing the settlement offer from Tower Hill insurance.
Reportedly, the suit against Mr. C eventually became a settlement to Mr. Shencavitz by SLohA's insurance carrier, resulting in a reimbursement of almost $5000 for vet bills. No money was ever recovered from Mr. C.
As a postscript to this, a few short months after the attack on Mr. Shencavitz's dog, JC's dog, again, savagely attacked a neighbor's dog while offleash and off JC's property. Again, the dog was a tiny yorkie and sustained extensive injuries and accumulated a large veterinary bill. This owner has not shared the settlement information.
Within a short time later, reported that Tower Hill would not cover future dog incidents under SLohA's policy.
OK so why is this coming up again?
Because...wish I had a dollar for every time someone said "Management doesn't obey SLR rules and BOD only wants to harass certain people". This is an example of that complaint--selective enforcement. To this day, has taken no steps to control the "grandfathered animals" or new entry of over-size and/or vicious animals inside the park and, has favored an individual who has made no restitution to either SLohA or the owner of the mauled dog.
Does this matter? Yes. Owners will not tolerate paying for MANBOD's ignorance, negligence and inconsistency in upholding lawfully-adopted rules & regulations and will rightly hold MANBOD responsible when it fails to reasonably pro-actively support valid rules. Future costs of threatened or actual lawsuits involving animal incidents will not be settled by Tower Hill. Owners will pay directly.
The attitude seems to be for MANBOD to get its own house in order before it starts pointing its fingers in the wrong direction and dialing 1-800-FINE-A-RESIDENT.
