Owners have been continuously denied voice in the commercial business (KCNetwork)
permitted on SLohA property by Board. This commercial enterprise is in direct violation of the Covenant against commercial activity in S-bag. The board would like owners to think that they, the board, can violate this covenant at will, but that is not the case. Indeed, the board attempted to amend the Covenants to specifically convey this power to the board in 2014. The amendment failed.
Disenfranchisement of owners began with SLohA paying for KCNet's tower site preparation and placement and exclusive use of KCNetwork server equipment in Annex property owned and paid for by owners. The expenses that owners have paid for may be known only to a few in Maintenance Department and Admin/Toneesha who pays the bills. Our employees were observed working on stab's towers and laying the concrete, paid for by our assessments, for stab's towers. We have graduated to having a line item added to our Reserves for "Towers" years before we owned them!
Beyond the obvious financial support given to stab, the attitude was reflected by the board when it answered an owner's question at at board meeting.
From BOD Minutes Oct 14, 2015: The owner asked the board directly if the owners would have an opportunity to vote on the towers.
The Board's response "NO".
This attitude has gained momentum over the years. The board has been progressively denying members access to information and participation in business affairs of SLohA. When Jm Ath asked for a breakdown of the many dollars that had been spent supporting stab's project, he met resistance, was supplied with partial information to try to interpret on his own and charged $60.
The 2015 plan to blatantly usurp and seize owners' common property with the Polk County's help was undertaken by a Board member's (D Brnd who has not made one cent on stab's project) sponsorship of stab's plan to modify the land use of SLohA in order to build tall internet towers, which currently pockmark the natural beauty of S-bag's common areas. S-bag has also paid repeatedly to bring in Tree Cutters to maim our trees to improve or access stab's signal.
In 2016, the Board purportedly entered into a Very ONE-SIDED lease with Virginia stab for SLohA to PAY stab for internet service, pay its taxes, pay for technical service to the towers and basically pay for everything connected to the operation of KCNetwork who expanded his business to hundreds of subscribers outside of S-bag. Presumably, Bb stab's felony history may have precluded HIM entering into an agreement and Virginia was enlisted to sign the papers). All the while, KCNetwork retained exclusive use of the towers OWNED by S-bag!
At the conclusion of Virginia stab's default period (30 days), S-bag will recapture the towers and have the right to lease these towers, and gain a profit, to other providers in the area. I can only hope that someone on the board actually READ the lease and certified a default letter to VIRGINIA stab.
Talks are already in progress with the various internet providers. Lease of the towers is potentially a very great source of income for S-bag, but a potentially profitable venture has been hoarded by KCNetwork, with the Board's permission, for many, many years. I cannot help but speculate what entities-besides KCNetwork- are profiting from the arrangement!
We are now beginning to see the consequences of the self-interested actions by the Board and its friends.
