The question came up today; how will I vote on the internet? I usually answer "as if" I was actually going to vote because the "real" answer is just too lengthy. So, I'm gonna post it here because it could apply to more owners in the future.
The real answer is "I will not vote" even though I will probably get a ballot from SLohA. That would be consistent with SLohA's position that the Covenants are not expired. My position is that the Covenants expired on my lot in 2010 so voting would be inconsistent. If the Covenants are expired, you cannot be a member of the Association, and you cannot vote.
The only obligation I have to SLohA is to pay the portion of actual costs of operating and maintaining SLohA-owned common property amenities and structures that existed when I accepted title.
Although there are many lots similarly situated to mine in status--perhaps 85% of the total in S-bag--this is not an issue for those owners THIS year. Those who choose to enjoin my lawsuit, however, will assert their non-membership in SLohA and should not vote next year.
