After speaking with a few owners who reported discussions about the internet fee with many unhappy people in various St ages of anger, I was asked to put together a form letter for people wanting to voice their objection to the Board. The letter should be signed and dated and hand-delivered to Shn. She will initial and date and then make a copy for you. There will be folks carrying the letter with them and will hand out copies when asked. Here is the text of the letter.
Date:
To: President, Vice President, Treasurer, Secretary of SLohA, the remaining SLohA directors and Sxxxxxxxx Ixx, Inc.
The purpose of this letter is to register my vigorous objection to the recent action taken by SLohA’s Board of Directors at the December 18, 2013 board meeting. According to a motion made and unanimously passed at this board meeting, it is the intent of this Board to offer members 2 options for approving the proposed budget; one with the proposed internet fee ($545/Q) and one without ($500/Q)--and to place the alternate budget options on the upcoming Election Ballot.
I, and many other owners, do not agree that this “internet fee option” is lawful—and ask that you state the authority by which you believe you have the right to levy assessments for a non-operating expense of the Association for the benefit of a private corporation. SLohA governing documents clearly require that all assessments must be levied and collected for the actual cost of operating and maintaining common property owned by the Association.
It is my belief that the Association is not complying with its obligations under the organizational documents and laws governing the Association by attempting to levy owners for an internet service that is not an actual cost of maintaining and operating SLohA-owned property. XX Net is a private, for-profit corporation and is not SLohA-owned.
Furthermore, XX Net has illegally sited its business equipment upon and is conducting business from private and common property contrary to the Covenants prohibiting commercial activity in S-bag.
Given the above, I respectfully request that you clearly state, in writing, the lawful basis which gives you the authority to levy and collect assessments for expenses which are not an operating or maintenance cost of managing SLohA-owned property and, to cite the authority permitting XX Nxxxxxx to conduct commercial activity on SLohA common property.

Great idea! Email has "metadata" attached and embeds an electronic bread crumb trail. It can never be "lost" like paper.

There is no "Vice President" email address.

Interest in resident forum is increasing and I decided to order the free vistaprint cards with pre-printed website address to give out to people who ask for it.

I have just gotten another email asking for more letters by another person who has been asked. I am going down to the 5 Cent copy machine later this morning to run off 50 to save my printer ink.

I have handed-out about 60 Objection Letters with a short cover letter with some details. Some residents took several sets, to hand out to their neighbors, who do not want or need a Internet Service. A few have a friend that are just getting by on a S.S. check each month.
Does anyone know how many letters have been signed and taken to the front office? I still have more residents to visit. I'm a Trying ;-)

I'm a Trying ;-) Be carefull, HH (the guy with the big head and the Sm all bird) has already harassed and verbally intimidated a man that's 88 years old and 2/3s smaller than him for doing the same thing. I hope he tries that with me . I'll be out and about doing the same and I have 30 people waiting for me to show up with the letters !

I am right in the middle of two Kay c N Towers also... OH, also under Security Type it shows : UNSECURE Not anything I would want in my home or in my Computer .

Yet another resident stopped by today and asked me if I had more letters; said they needed another 20. That's 4 selfless, civic-minded people that I know of who are distributing letters to concerned owners. There is absolutely nothing "in it" for them. Indeed, they are subject to the likes of BirdMan cH allenging and mocking their effort!
As a convenience, the letters are being accumulated for a batch delivery to the office. Please get your signed letter back either to Shn or to the person who gave you the letter.
There is mounting alarm with the steady arrival of the January snowbirds who are just now hearing about this internet extortion fee. There is talk (and some action) about contacting the Attorney General, SEC, the FCC, the Department of State, Polk County Land Planning, Polk County Tax Collector and Tower Hill Insurance Agency. Also an attorney. It is my understanding that some of the agencies above have already been contacted.
Many of the folks who are concerned about this do not now have internet and cannot even read about what is going on. They must rely on others' reports and hope to get accurate information. Some of these people are vulnerable to any disturbance in their precarious financial equilibrium and any shift demanding more from them could be quite distressing. There is one owner who intends to contact Elder Affairs organizations and media. But, this is very problematic when you are "paper-based" in a highly social and technology-dependent society. I intend to do everything in my power to advocate for this vulnerable group of owners.
Letter signors should protect whatever rights are left to us in this HOA and put the Board and K C N on notice of the intolerable breach of covenant they are about to commit by sponsoring the vote for the benefit of a few members (including Board members) and a private corporation. Be sure to get your receipted copy of the letter back from Shn if you deliver it yourself.
And to those who can only think of "ME, ME, MEEEEEE" you might earn a very painful lesson in the immorality of selfishness and greed on the backs of your neighbors. It appears that there are many people in here who will act solely in their own personal advantage "Me.. Me..Me" regardless of the hardships it will bring to their neighbors and financial damage it will cause to the community. It appears that there could be "breach of covenant" litigation regardless of the outcome of the vote, but perhaps this situation has a chance of mitigating itself with a majority NO vote.

There is suddenly a rumor going around that the Internet fee has been dropped from the ballot. This rumor started on a weekend and it coincides with the "Letter of cH allenge" that is being passed around and signed by owners.
I cH allenge the rumor! I suspect that the manbod does not wish to get the "Letters of CH allenge" as it will then become a legal document to them.
Please get the "Letters of CH allenge" to the office on Monday before the next bod meeting!!!! Time is of the essence.

Definately--owners should continue to register their objection IN WRITING! Just in case...doesn't cost you a penny and it might help you protect your position down the road. I know many people are talking about just NOT PAYING the internet extortion fee if it passed. These folks especially--do deliver a letter and get a receipted copy for your records. It won't prevent them from putting a lien on your property, but the judge might be more willing to hear your story if you have documentation.
And, it is possible that a breach of covenant suit is going to be filed at some point. It is not known, at this point, to what extent this K C N problem is part of the expiration of Covenants.
MANBOD can no longer hide from the owners who now demand some accountability. If it is not voluntarily given, owners can proceed according to their collective desire--either recall these directors, replace them with responsible adults and oust the or get together, combine some money and hire an attorney to force them to do what is necessary and long overdue--get K C N off SLR property once and for all. We can no longer afford to turn a blind eye to this trespass on our property.

Over 100 Objection letters were hand-delivered to the office, according to Shn. That was the estimate before another 15-20 were still undelivered...
Many are awaiting for BOD's written response to the TWO questions asked in the letter:
What is your authority for assessing a fee for a non-operating cost of the common property?
and
By what authority is K C N doing business on SLohA common property contrary to the Covenants prohibiting commercial activity?
