Q: Thanks for the information on ADA & HOAs... Is the Sunday's church service or bingo at the clubhouse make the HOA subject to ADA requirements?
A: Yes, church services, bingo, guest speakers/performers at KK and memorial events all make SLohA subject to ADA requirements because they allow the public onto our property.
Also, the Administration Office and parking is subject to ADA-requirements because it receives the public--police, civil servants, visitors and contractors. This must be done at SLohA's expense.
Q: So why would the Bingo Committee give a Donation for a E lectric door opener at the Club House. That was not right, the monies should have been Donated to a local Charity in Polk Co.
A: Well...that IS the question eh?
Here's my guess. These kinds of things don't come out of "nowhere". SLohA is not known for being proactive in areas involving the outside world--(or even our own bubble-world).
I would theorize that SLohA has had a visit and inquiry from the Attorney General's staff about its unlawful conduct of Bingo gaming under Florida statute. AG's concern passed to SLohA's attorney. SLohA's attorney advised SLohA to get its act together on both Bingo and compliance with ADA requirements. AG and SLohA's attorney also advised that responsibility for the payment of alterations to common property used by the public was SLohA's.
AG may also have advised that SLohA must return its unlawful receipt of previously-"donated" funds by Bingo to...Bingo! Thus, SLohA will have to reimburse/pay for the auto door opener (and possibly the cost of installed interior spycams) from the Operating funds, further stressing an already overworked budget.
No matter, IT can just pull out her SLohA credit card and use it to float a high interest credit loan to pay back the misdirected funds.
