Many are questioning the huge number of ballots that were declared to be abstentions by Election Committee. It is not surprising that a few people would abstain and NOT have an opinion on the internet/budget question, but this is quite unbelievable when this is reported in such huge numbers. It could conceivably reflect confusion in the "complex, dual ballot" described by the SLohA attorney in its opinion of the illegality of the ballot ratification of the budget. But, it is still very questionable.
In light of the "no confidence" that many Members have for this board, there is good reason to demand a RECOUNT. This can be accomplished fairly easily and is provided for, in detail, in SLohA Bylaws. Generally, you have 60 days post-election to get 100 parcel signatures requesting a RECOUNT. In addition, a recount of votes sH all be conducted regarding any position or proposition included in the ballot upon submission of a petition within 60 days following the election, signed by at least 100 authorized voters, requesting said recount. In the event a recount of votes is authorized as hereinbefore provided, the President of S-bag Lake Owners Association, Inc., (hereinafter referred to as the “Association”) sH all immediately appoint a Chairperson from the then roster of owners/members of the Association who, in turn, will appoint four additional persons to serve as a Recount Committee. The names of the Chairperson and the Recount Committee sH all be presented to the Board of Directors for their approval. As soon as practical thereafter, the Recount Committee sH all convene and sH all thereupon recount all votes cast in connection with the position or item in dispute. The resultant tally of the recounted votes sH all be certified by all Recount Committee members and sH all be presented to the Board of Directors. The certified report of the Recount Committee sH all be deemed the official result of the election in question.
