Seller DisclosureThis is the Seller's Disclosure Form (5 pages) used by Florida realtors. Click on the 1st page of the thumbnail to read or just scroll down and download the file. Disclose anything that can materially affect value or desirability. Deciding what affects the value is not judged subjectively, and it doesn’t matter if the particular item bothered the seller. Especially disclose facts that are not readily available by observation that can materially affect the Buyer after the sale. A good example which has come up many times to bite Sellers is the "Inside Knowledge" of an imminent Special Assessment that is going to be levied on homeowners. Knowing this, the Seller decides to unload the home (and the anticipated Special Assessment) on the Buyer. This is not discoverable and the Seller should disclose or risk the Buyer coming back with a fraud accusation!The general rule is "if in doubt, DISCLOSE".
