Here is the content of the second complaint against stab for "building without a permit". Next followup is 9/26/14. Note that this case has been continued for Oct 16, 2014. Attachment Deleted
Attachment DeletedNote that THIS case is against stab at his personal property residence--SLohA property is not involved--yet Mamager "speaks" to the County on behalf of stab referencing the engineering reports. Note that Mr. Internet Bb tells County that his tower is erected to serve internet to the S-bag Lake MHP. Note that Mr. Internet Bb tells County that he gave "the other 4 towers" to S-bag Lake Homeowners Association. Mr Bb continues to assert his protection from violations by FCC requirements and County maintains that permits are still required, nothwithstanding what the FCC says and they will need to do more research on that subject.

Fortunately, KCNET does not have a monopoly on internet service. One can also get it from Verizon and Sprint.
If KCNET interrupts service to 2000+ subscribers (mostly outside S-bag), it might be because it will be ordered to remove the illegal towers from the common property and do business like everyone else has to--according to the law.
If there has been some unknown mechanism that owners are not aware of transferring the illegal towers to SLohA, the owner--SLohA-- will remove the towers and KCNet will have to do what it needs to do to continue to provide internet access.
Owners should keep in mind--KCNet, the business operating on SLohA common property and installing tall communications towers on the property--is trespassing. Our community is zoned residential. Our Declaration of Covenants strictly forbids commercial enterprises from operating in S-bag.

Thank you for including us in the Forum. I would hope that this does not interrupt our internet service in the Resort either as is or parkwide, KCN may go the way of Lake Wales Wireless.
Everyone pays for their years' usage up front and then, one day you get out of bed, have coffee, turn on the old computer and NO INTERNET, NO PHONE, NO EXPLANATION, NO REFUNDS.
If that is what happens to KCN it will be no fault of this forum or anyone associated with it.

They are scheduling a hearing on this issue on October 16th. Presumably, the testimony of SLR owners, as well as the documentary evidence accumulated from the Official Records Requests, will then be entered into the record. Mark your calendars--October 16th--to be present and support the effort to dismiss the violation against SLohA and place it where it belongs--KCNetwork! The "good" news is that the complaint against KCN/St aib has been replaced with a new and expanded complaint. It is attached. In addition to the original "building without a permit" violation, FOUR (4) more violations have been added: Excerpts from Complaint CE14-6767 dated 9/11/2014 1. Land Use-Standard Districts Sec 205 Table 2.1 Standard Districts 2. Accessory Structure- Sec 209 3. Accessory Use - Sec 206E 4. Conditional Use Approval Requirements-Chapter 3-Conditional Uses 5. IF Alc Nttr MADE A MOTION TO SPEND $3,200 DOLLARS OF SLohA MONEY ON AN ENGINEER'S STUDY REGARDING THE FOOTINGS OF THE COMMUNICATION TOWERS BUILT WITHOUT PERMISSION THEN SLohA MUST BE HELD ACCOUNTABLE. What about Polk County's Request for an Engineer's Study for all KCNet Towers on SLR's common property? pestcontrolThe hearing has been rescheduled for January 2015 in order to afford an opportunity for owners to participate in the public hearing. In the interim, County Code Enforcement staff,along with Polk County Attorney, will meet with the association and KCnetworks about the several violations.
