It is the intent of sponsors of this legislation that it will lead to a second piece of legislation that will include proposals for an estimated $2 annual fee from home owners and a ban against liens placed on properties when the home owner can’t afford HOA fees.
The $2 fee would be used to finance the new HOA office with the DBPR.
HOA REGISTRATION
The Florida Department of Business and Professional Regulations issued a press release on Sept. 27 regarding the launching of a website where Florida homeowners' associations and community association managers are now required to register.
The registration requirement is a result of recently passed legislation that requires community association managers (or management companies) or an HOA itself, if not professionally managed, to report information about the HOA. The deadline for registration is Nov. 22.
The information required to be reported on the registration includes:
Legal name of the HOA.
Federal employer identification number.
Mailing and physical address.
Total number of parcels.
Total amount of revenues and expenses from the association's annual budget.
If the HOA is professionally managed, the CAM must include the CAM licensing number. CAMS can be held liable for violations of state laws affecting community associations which are committed in the course of providing management services, including the failure to register an HOA by the deadline.
